Process, procedures for exporting the latest Tra fish in 2023


I. Procedures for exporting Tra fish

Exporting fish is one of the important economic sectors of Vietnam, making a significant contribution to the country's total export turnover. To effectively implement the procedures for exporting Tra fish, businesses need to comply with a series of complex procedures and regulations. In this article, H-Cargo Logistics will provide detailed information on the procedures for exporting Tra fish, from business registration, product quality processing to managing necessary documents.

II. Current policies

According to Decree No. 55/2017/ND-CP, registering export contracts for various types of Tra fish with the Vietnam Tra Fish Association is no longer a mandatory requirement for businesses. However, to implement the export process, businesses must comply with new conditions as follows:

  1. Firstly, Tra fish products must be processed at facilities that meet the requirements specified in Article 5 of this Decree. In case the requirements in Article 5 of the Decree are not met, businesses must meet one of the following conditions:

Have a contract to purchase Tra fish products processed at facilities that meet the requirements of Article 5 of this Decree.

Have a contract for processing Tra fish products with the owner of the facility that meets the requirements of Article 5 of this Decree.

  1. Secondly, products must meet the quality and food safety conditions specified in Article 6 of this Decree, along with the regulations of the importing country. In case the importing country has different regulations from Vietnamese law, the regulations of the importing country shall apply.

III. HS code and export tax


1. HS code

Determining the HS code is an important and indispensable step when carrying out export procedures for any type of goods. The HS code not only determines the export tax rate but also applies to calculating value-added tax (VAT) and other export policies. To accurately determine the HS code for the Tra fish product you are exporting, you can check in the following document:

Here, frozen, excluding fish fillets and other fish meat of heading 03.04.

0304

Filleted fish and other types of fish meat (fresh, ground, minced), fresh, chilled or frozen.

Depending on the product from your company, whether it is whole frozen fish or fillets, the appropriate HS code should be applied.


2. Export tax

Tax policy: Catfish, as regulated by law, falls under the code group mentioned above, so there is no export tax (0%) and no VAT (0%) for exported goods.


IV. Customs dossier

Based on the regulations in Clause 5, Article 1 of Circular 39/2018/TT-BTC (amending Article 16 of Circular 38/2015/TT-BTC), there are requirements for customs documents that the customs declarant must submit and present in the export procedure for catfish as follows:

  1. Electronic customs declaration: submit 01 original copy;

  2. Commercial invoice;

  3. Sales contract;

  4. Packing list;

And some other documents that may be required according to the needs of the importing partner:

  1. Certificate of Origin;

  2. Food safety and hygiene certificate, ...

  3. Veterinary Certificate.


V. Export procedure

Before proceeding with the export procedure, you need to thoroughly understand the current import regulations of the country you are trading with. These regulations may relate to import duties, safety and quality standards, and necessary documents. And follow the following procedure:

Step 1: Prepare and control the source of exported catfish

The business needs to check whether the catfish product is included in the list of permitted exports before proceeding with the export. The exported catfish batch needs to be transported in refrigerated containers with a properly maintained temperature, using supporting equipment to ensure stable temperature throughout the transportation process. In addition, the catfish batch needs to be carefully arranged, ensuring that the cold air flow is maintained and circulated throughout the transportation route.

Step 2: Check the export documents

To comply with the current regulations, the unit needs to complete all necessary documents for exporting catfish products. Especially for catfish products, the shipper needs to ensure that they have registered for animal quarantine before proceeding with the export, to ensure compliance with food safety and quarantine regulations.

Step 3: Register animal quarantine for the catfish batch

To comply with the current regulations, you need to register for animal quarantine at the Department of Animal Health. This process includes the following steps:

  1. Submit the quarantine registration dossier: The exporter submits the quarantine registration dossier to the Department of Animal Health for the catfish batch. The quarantine registration dossier must include:

  • Declaration of quarantine according to the prescribed form.

  • In case of animals, aquatic animal products under the management of other relevant competent state agencies, submit documents or permits as prescribed.

  • Requirements for quarantine of the importing country (if any).

  • Certificate of disease safety of the fish farming facility of origin of the catfish for the production of the batch (if any).

  • Other relevant documents depending on the specific exported catfish product.

  1. Inspection and testing of products: Officials in the Department of Animal Health will assess the quantity, type, and take samples of the product for necessary testing. This process ensures that the catfish product meets the animal quarantine and food safety standards.

  2. The time for issuing the quarantine certificate is as follows:

  • For batches that require sampling for inspection: within 05 working days from the start of the inspection, the animal quarantine agency at the border gate issues the animal quarantine certificate, imported aquatic animal products related to catfish products that meet the standards for the shipper to complete the customs procedures. If it takes more than 05 working days, the animal quarantine agency at the border gate will notify the shipper in writing and state the reason.

  • For batches that do not require sampling for inspection: within 01 working day, the animal quarantine agency at the border gate issues the animal quarantine certificate, imported aquatic animal products after inspecting the dossier to meet the requirements for the shipper to complete the customs procedures.

The exporter relies on the time recorded on the appointment slip to come to the Department of Animal Health to receive the quarantine certificate.

Step 4: Perform customs declaration procedures

After completing the documents, the shipper needs to proceed with the electronic customs declaration for the catfish batch. This process requires the customs declarant to enter complete information about the catfish product when declaring, to avoid errors that may affect the customs clearance process. Especially, if the batch owner has no experience, using customs procedure agency services is a smart choice. This will help ensure a safe and fast declaration process, while avoiding unnecessary risks.

Once the declaration is completed and the declaration form has been transmitted, the system will automatically issue a number if the information is detailed and complete. The importer needs to confirm the information to ensure there are no errors. At the same time, they need to pay taxes and submit necessary documents to the customs office according to the information declared on the declaration form.

In addition, the decision on the actual inspection of goods depends on the sorting results. There are three specific sorting results: Green, Gold, Red.


VI. Notes when exporting Tra fish.

  1. Temperature: Each refrigeration device has its own adjustable temperature. Therefore, to ensure the best conditions for goods, you need to provide the recommended temperature accurately so that the appropriate temperature can be set.

  2. Air circulation: Ensure that the air in the refrigeration device circulates most effectively. This helps eliminate unwanted odors from goods, maintain humidity, and prevent water condensation on the surface of goods as well as on the refrigeration device.
