  • Oversized and Overloaded Cargo Transportation (also known as Overdimensional and Overweight cargo) involves transporting cargos that exceed the size or weight limits set by the Ministry of Transport of Vietnam. These cargos are usually unable to be divided or disassembled and must be transported as a whole.

  • Regulations on Oversized and Overloaded Cargo (Overdimensional and Overweight cargo):

    • For Oversized Cargo (Overdimensional cargo): It refers to cargosthat cannot be disassembled and have one of the following dimensions when loaded onto a transportation vehicle:

      • Length greater than 20 meters.

      • Width greater than 2.5 meters.

      • Height measured from the highest point of the road surface upwards exceeding 4.2 meters; for container-carrying vehicles, it exceeds 4.35 meters.

    • For Overloaded Cargo (Overweight cargo): It refers to cargos that cannot be disassembled and have a weight exceeding 32 tons.

III. Considerations for Oversized and Overloaded Cargo Transportation

1. Regulations for the operation of Overloaded and Oversized vehicles, Super-sized and Super-heavy cargo transportation

a. Operation of overweight vehicles, oversized vehicles, tracked vehicles on roads (excerpt from Article 11 of Circular 46/2015/TT-BGTVT)

  • The operation of overweight vehicles, oversized vehicles, tracked vehicles on roads must ensure traffic safety and the safety of road construction.

  • The vehicle owner, transporter, lessee, or vehicle operator must comply with the following regulations when operating overweight vehicles, oversized vehicles, and tracked vehicles on roads:

    • Possess a permit for the operation of overweight vehicles, oversized vehicles, and tracked vehicles on roads issued by the competent authority.

    • Comply with the regulations stated in the permit for the operation of the vehicle.

  • Cargo-carrying vehicles exceeding the allowed cargo weight specified by the manufacturer's design or exceeding the allowable cargo weight stated in the vehicle's safety and environmental protection certification are not allowed to operate on roads.

b. Operation of super-sized and super-heavy cargo transportation vehicles on roads (excerpt from Article 14 of Circular 46/2015/TT-BGTVT)

  • Super-sized and super-heavy cargo transportation vehicles must comply with the regulations in Article 11 of this Circular.

  • Cases requiring escort vehicles:

    • When loading cargo onto transportation vehicles with the following outer dimensions (of the vehicle combination and the cargo loaded on the vehicle): width exceeding 3.5 meters, length exceeding 20 meters.

    • Reinforcement of road infrastructure is required at construction sites.

  • Cases requiring road surveys:

    • When loading cargo onto vehicles with the following outer dimensions: width exceeding 3.75 meters, height exceeding 4.75 meters, length exceeding 20 meters for roads of grade IV or below; or exceeding 30 meters for roads of grade III or above.

    • Motor vehicles on roads with a total weight or axle load exceeding the road's operating capacity.

2. Other notes:

a. For drivers and transportation vehicles

  • Drivers must be in good health and have a good understanding of the routes.

  • Drivers need to comply with all laws to ensure absolute safety when participating in traffic and avoid causing damage to road constructions during the transportation of Oversized and Overloaded Cargo.

  • Types of vehicles transporting Oversized and Overloaded Cargo must be registered and inspected according to the prescribed periodicity.

  • Vehicles transporting Oversized and Overloaded Cargo must have a permit for operation according to the regulations for each type of vehicle, and they must fully comply with the regulations in the vehicle's permit for operation.

b. For the cargo

  • Regarding arrangement: Cargo needs to be arranged compatible with the transport vehicle. It should be securely wedged, tied, cushioned, and supported to ensure safety during transportation. Additionally, the appropriate lifting equipment should be used when loading and unloading cargo.

  • Regarding cargo safety: Drivers need to regularly inspect the cargo throughout the transportation process, especially the fastening chains, cargo binders, etc.

c. For transportation routes

  • The delivery location should allow access for large vehicles without affecting the roads, power lines, trees, surrounding buildings, etc.

In the case of modular trailers used for Super-sized and Super-heavy cargo transportation, the inspection agency confirms in the vehicle's safety and environmental protection certification with the following content: "Permitted to connect modules together and must have a permit for vehicle operation issued by the competent authority."

IV. Causes and Consequences of Transporting Overweight and Overloaded Cargo Contrary to Regulations:

1. Some causes of failure in organizing plans and transporting overweight and overloaded cargo

  • Transport vehicles lacking appropriate permits for transporting overweight and overloaded cargo according to the type of cargo and the intended route.

  • Transport vehicles not undergoing regular maintenance/technical inspections before being used for transportation.

  • Inexperienced drivers in handling specialized cargo and lacking experience in route planning.

  • Failure to conduct surveys of the cargo and route before transportation.

  • Inaccurate transmission of information among the parties involved in the transportation, such as delivery time, dimensions, and weight of the cargo.

2. Consequences:

  • Failure to deliver cargo on time leads to additional costs such as storage fees at ports, vehicle anchorage, labor costs, road repairs/public property repairs, alternative transportation arrangements, etc.

  • Potential traffic accidents during transportation, causing damage to public property and human casualties.

  • Adverse effects on the progress of projects/construction/production, impacting supply chains and resulting in production and sales losses

V. Solutions for Transporting Overweight and Overloaded Cargo:

  • Ensuring accurate, sufficient, and timely communication of information among the relevant parties.

  • Conducting practical surveys of cargo and transportation routes before organizing the transportation of overweight and overloaded cargo.

  • Developing preliminary plans, assessing potential risks for each plan, and establishing contingency plans.

  • Providing professional training and maintaining high discipline for the transportation of overweight and overloaded cargo.

  • Regular inspection and maintenance of vehicles/equipment.

  • Developing insurance plans for cargo throughout the transportation process.
