  • Loading and unloading machinery: Including cranes (wheeled and tracked), excavators, and other types of material handling vehicles used in loading and unloading operations.

  • Agricultural and forestry production specialized motorcycles: Including wheeled tractors, tracked tractors, and other types of machinery used in agricultural and forestry production activities.

    • According to the regulations, forklifts, excavators, wheel loaders, crawler cranes, etc., are under the management of the Ministry of Transport, not the Ministry of Science and Technology. Therefore, motorcycles over 10 years old can still be imported.

  • Circular 12/2022/TT-BGTVT regulates the list of products and goods that can potentially cause safety hazards under the state management responsibility of the Ministry of Transport.

  • However, you should note that in Appendix I.II.8 of Decree 69/2018/ND-CP, it explicitly states the types of goods prohibited from importation, including "Motorcycles, used specialized motorcycles, and motorcycles with erased, altered, or re-issued chassis numbers and engine numbers," whether they are used or new. If imported intentionally or unintentionally, they will be seized.

  • Specifically, Decree 69/2018/ND-CP states that the following types of motorcycles are prohibited from importation: a) Right-hand drive vehicles (including detachable forms and vehicles that have been converted to right-hand drive before being imported into Vietnam), except for specialized vehicles with right-hand drive operating in narrow range and not participating in traffic, including cranes; trenching machines; road sweepers, road sprinklers; garbage and household waste transport vehicles; road construction vehicles; airport shuttle buses; warehouse forklifts, port forklifts; concrete pumps; vehicles used only in golf courses, parks. b) Cars, four-wheel vehicles with engines and assembled components that have been erased, altered, or re-issued chassis numbers and engine numbers. c) Erased, altered, or re-issued chassis numbers for trailers and semi-trailers. d) Erased, altered, or re-issued chassis numbers and engine numbers for motorcycles, specialized motorcycles, and motorized bicycles.

3. Detailed implementation procedure:

Step 1: Vehicle Registration

  • Before the goods arrive, when you have a shipping notice, you can prepare the registration documents with the registration agency. Currently, the submission of documents is done through the National Single Window, and no longer requires physical documents as before.

  • After the valid documents are submitted, the Registration Authority will issue a registration number on the registration certificate. You enter the registration number and (if necessary) attach the registration certificate file to the electronic customs declaration and transmit the declaration through the VNACCS software.

Step 2: Customs Procedures

After transmitting the declaration, you bring the document set to the customs office for further procedures. Since the goods need to be registered, they will go through the Red or Yellow channel, not the Green channel.

Required documents:

  • Commercial Invoice

  • Packing list

  • Technical specifications (Catalogue)

Step 3: Bring the Goods to the Storage Warehouse

There are two locations where the registration officer can conduct actual inspections:

  1. In the owner's private warehouse

  2. At the port where the vessel unloads the goods

  • For small-sized goods such as forklifts and excavators, which are packed in containers, it is recommended to choose option 1: bringing them to a private warehouse for registration. This option is convenient for installation and test runs, as well as saving storage fees at the port.

  • For goods that are not packed in containers (breakbulk shipments), you can choose either of the two options above.

  • For the first case: If you want to temporarily release the goods to the warehouse while waiting for the inspection results, you need to submit additional documents to the customs requesting approval to bring the goods to the storage warehouse.

Required documents:

  1. Request letter to bring the goods to the private warehouse for storage, according to Form 09/BQHH/GSQL in Circular 38/2015/TT-BTC

  2. Warehouse layout design diagram

  3. Firefighting and prevention assessment for the warehouse

  4. Documents proving the right to use the warehouse (such as the warehouse rental contract, land use certificate)

  • When you submit the complete and compliant documents along with the request to bring the goods to the warehouse, and pay the import tax (usually 0% for import tax and 10% for VAT), if the customs officials find the documents in order and the tax has been paid, they will approve the goods to be brought to the storage warehouse. You can then move the goods to your private warehouse and proceed to the next step...

Note: During the storage period while waiting for customs clearance, the owner is not allowed to use or engage in commercial activities with the goods. Violations will result in penalties.

Step 4: Actual Inspection and Registration

  • After the goods arrive at the warehouse, you need to install and test the machinery. During this process, it is important to check the chassis and engine numbers to ensure accuracy. If everything is fine, you should invite the registration officer to conduct the actual inspection. If you are working with a service provider, they will notify the registration authority to arrange for an officer to inspect the goods at your warehouse.

  • Depending on the location of your warehouse, the registration authority will assign an officer for the inspection. If you leave the goods at the port, for example, when the vehicle is transported by breakbulk shipping, you should also request a registration inspection at the port.

  • After completing the inspection and registration process, you will have to wait for the inspection results, which usually takes 5 to 7 working days.

Step 5: Customs Clearance

  • When you receive the inspection results (online), you inform the customs officer to check the system and complete the customs clearance process.

  • At this stage, the goods can be officially used, exchanged, and traded.

Note: Section 2, Article 3 of Circular 12/2022/TT-BGTVT, which takes effect from 15/08/2022, states that after receiving a registration request from the Vehicle Registration Agency, the track chains will be opened for the declaration of Customs and customs clearance of the batch without waiting for the inspection results.
